Title: Consummation of marriage is not a prerequisite for the validity of nikaah

Question

asalamualaykum,

 i have recntly asked a question about if a couple has to sleep together after nikaah to make it valid and if they dont will it become in valid but I have not received the answer to it, my friend wants to knw plz could you reply as soon as possilbe...

Answer

In the Name of Allaah, the Most Gracious, the Most Merciful.

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh.

In principle, the validity of one’s nikaah is not based on the consummation (engaging in conjugal relations) of the marriage. A nikaah will be constituted and regarded to be valid once the proposal and acceptance in the presence of two witnesses is found, irrespective of whether the couple engaged in intimacy or not[1].

قال القدوري رحمه الله في «كتابه»: عقد النكاح ينعقد بلفظين يعبر بهما عن الماضي نحو أن تقول المرأة: زوجت، ويقول الرجل: قبلت، قال: وينعقد أيضاً بلفظين أيضاً، يعبر بأحدهما عن المستقبل نحو أن يقول الرجل: زوجت

 ينعقد بالإيجاب والقبول وضعا للمضي أو وضع أحدهما للمضي والآخر لغيره مستقبلا كان كالأمر أو حالا كالمضارع ، كذا في النهر الفائق
