Title

Q : I am from Ansar, Can I marry Abbasi?

Question

Janab mera sawal ye hay k me Ansar(Basran) family say tauluk rakhta hon. parha likha or barsry rozgar hon. Me ek aisi larki say Nikah karna chahta hon jis ka tauluk Abbasi family say hay. Wealth k lihaz say dono famlies equal hain. Religion b same hy. Kaya Islamic nukta nazar say is rishty me koe restriction hay? Kaya is Nikah me Restrict karna jaiz hay? Mehrbani farma k mjy tafseeli jawab dain. Shukaria.

In the name of Allah, Most Gracious, Most Merciful


Assalaamu `alaykum waRahmatullahi Wabarakatuh

 

Islām stresses mankind to fulfill both kinds of rights obligatory on them, namely huqūq Allāh (the rights of Allāh) and huqūq al-'ibād (rights of other people).  Examples of huqūq Allāh would be praying and performing the Hajj, whereas examples of huqūq al-'ibād would be to protect other people's honor and preventing yourself from causing any harm to them.  One such way a person might feel as if their honor has been tainted is when a member of his/her family marries a person who is not suitable according to the family's standards.  These standards are in relation to the family's lineage, wealth, religiosity, and occupation.

 

Although you might be equal or higher to the girl's family in wealth, religiosity, and occupation, the lineage of someone from the Abbāsī family is higher than the lineage of someone from the Ansār family.  This is because the Abbāsī family is from the Quraysh, and the lineage of the Quraysh is considered as higher than the lineage of the rest of the Arab (and non-Arab) tribes. 

 

Therefore, if the girl's family feels unsatisfied in marrying her to someone who is not the same as her in lineage, they have a right to object to the marriage.  Such a marriage will not be valid without the approval of the girl's family.  However, if the girl's family approve of the nikāh, then the marriage is valid and no one else has any right to object.

 

[Urdu Transliteration]

Islām logon pe dono huqūq adā karne kā khūb zor deta he, jo ke huqūq Allāh (Allāh Ta'ālā ke huqūq ham par) aur huqūq al-'ibād (dūsron ke huqūq ham par) kehlate hai.  Huqūq Allāh ki misāl namāz aur rozā hai, aur huqūq al-'ibād ki misāl dūsron ko apne sharr se bachānā aur unki 'izzat ko dāgh na lagānā hai.  Ek tarīqah jisse logon ki 'izzat par dāgh lagta hai wo ye hai ke apne khāndān me se koi aise shakhs se shādī karre jo ke nasab, māl, dīn, aur kārōbār kī haysiyat se nīche ho. 

 

Hālānke āp larkī ke khāndān me māl, dīn, aur kārōbār kī haysiyat se barābar hai, magar Abbāsī khāndān ka nasab Ansārī khāndān se unchā hai kyun ke Abbāsī Quraysh me se hai, aur Quraysh ka nasab sab se ūnchā nasab hai.

 

Is liye, agar larkī ke khāndān wāle apne nasab se nīche wāle nasab se shādī karāne ke liye rāzī nahī hai to inku i'tirāz kā haqq hai.  Aysī shādī larkī ke khāndān ke razā mandī ke khilāf sahīh nahi hogi.  Magar agar larkī ke khāndān wāle rāzī hai to phir shādī durust hai aur phir kisī aur ku i'tirāz kā haqq nahi.

 

فالنكاح الذي الكفاءة فيه شرط لزومه هو إنكاح المرأة نفسها من غير رضا الأولياء لا يلزم حتى لو زوجت نفسها من غير كفء من غير رضا الأولياء لا يلزم وللأولياء حق الاعتراض لأن في الكفاءة حقا للأولياء لأنهم ينتفعون بذلك...ولو كان التزويج برضاهم يلزم حتى لا يكون لهم حق الاعتراض

والعرب بعضهم أكفاء لبعض بالنص ولا تكون العرب كفأ لقريش لفضيلة قريش على سائر العرب ولذلك اختصت الإمامة بهم

( وله ) أي للولي...( الاعتراض في غير الكفء ) فيفسخه القاضي

قال الإمام ابن عابدين في حاشيته:

قوله ( في غير الكفء ) أي في تزويجها نفسها من غير كفء

(و) الكفاءة (هي حق الولي لا حقها)

قال الإمام ابن عابدين في حاشيته:

قوله ( هي حق الولي لا حقها ) كذا قال في البحر واستشهد له بما ذكره الشارح عن الولوالجية وفيه نظر بل هي حق لها أيضا

الكفاءة تعتبر في أشياء منها النسب فقريش بعضهم أكفاء لبعض كيف كانوا حتى أن القرشي الذي ليس بهاشمي يكون كفئا للهاشمي وغير القرشي من العرب لا يكون كفئا للقرشي والعرب بعضهم أكفاء لبعض الأنصاري والمهاجري فيه سواء كذا في فتاوى قاضي خان
