Title: She went to Makkah without donning Ihram and reciting the Talbiyyah

Question

a womans period started in madina. thinking she doesnt have to make niyyah or resite talbiya she went straight to makkah without dorning ihraam etc. what must she now do if she has to go to meeqat can she go to any meeqat kindly give the answer with refrencas

Answer

In the name of Allah, Most Gracious, Most Merciful  

Assalaamu `alaykum waRahmatullahi Wabarakatoh

If a woman passes the miqaat without donning the ihram, she will have to return to any one of the miqaats and don ihram from there.  If she does return to a miqaat and dons the ihram from Makkah, she will have to give one dam (slaughter one goat/sheep).

( وحرم تأخير الإحرام عنها ) كلها ( لمن ) أي لآفاقي ( قصد دخول مكة ) يعني الحرم ( ولو لحاجة ) غير الحج أما لو قصد موضعا من الحل كخليص وجدة حل له مجاوزته بلا إحرام فإذا حل به التحق بأهله فله دخول مكة بلا إحرام وهو الحيلة لمريد ذلك إلا لمأمور بالحج للمخالفة...قال ابن عابدين: ( قوله وحرم إلخ ) فعليه العود إلى ميقات منها وإن لم يكن ميقاته ليحرم منه ، وإلا فعليه دم
